Terms of Service
These Terms of Service (“Terms”) are a legal agreement between you and Vincent Catalano (“Voyica,” “we,” “us,” or “our”), a sole proprietor based in Texas, United States, governing your access to and use of voyica.com (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or legal guardian’s permission to use the Service. By using the Service, you represent that all information you provide is accurate and current.
2. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at vinnie.catalano3@gmail.com of any unauthorized use. We are not liable for losses caused by unauthorized use of your account.
3. Subscriptions and Billing
3.1 Plans
Voyica offers a free tier and paid “Voyica Pro” subscriptions billed monthly ($12/month) or annually ($99/year). Prices are in U.S. dollars and may change with at least 30 days’ notice for renewals.
3.2 Auto-renewal
Paid subscriptions automatically renew at the end of each billing cycle until cancelled. You authorize us (through Stripe, our payment processor) to charge your payment method on each renewal date.
3.3 Cancellation
You may cancel auto-renewal at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you will retain Pro access until that date. Refunds are governed by our Refund Policy.
3.4 Failed payments
If a payment fails, we may retry the charge for up to 14 days. If still unpaid, your account may be downgraded to the free tier without notice.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Scrape, crawl, or systematically extract data from the Service except via clearly designated APIs
- Reverse engineer, decompile, or attempt to extract source code
- Reuse or republish Voyica’s data, lists, rankings, or original content without written permission
- Interfere with the operation of the Service, including denial-of-service attempts, attempts to bypass authentication, or excessive automated requests
- Impersonate another person or misrepresent your affiliation
- Upload malicious code or content that infringes the rights of others
- Share your account credentials with others or use one account on behalf of multiple users
We may suspend or terminate accounts that violate these rules without prior notice.
5. User Content
You retain ownership of content you submit to the Service (e.g., trip plans, group notes, feedback). By submitting content, you grant Voyica a worldwide, royalty-free, non-exclusive license to use, store, reproduce, and display that content solely as needed to operate and improve the Service. You represent that you have the rights to submit any content you provide and that it does not violate any third-party rights.
6. Intellectual Property
The Service, including software, design, original written content, and aggregated data compilations, is owned by Vincent Catalano and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes consistent with these Terms. The “Voyica” name and logo are our trademarks; you may not use them without permission.
Underlying source data (e.g., Numbeo, WHO, TasteAtlas, Ookla) belongs to its respective owners. We do not claim rights to upstream data; we claim rights to our compilations, scoring methodology, and original written content.
7. Third-Party Services
The Service integrates with third-party services including Google Firebase (authentication, database) and Stripe (payments). Your use of those services is governed by their own terms. We are not responsible for their actions, outages, or data practices.
8. Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. We disclaim all warranties to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
Cost-of-living, safety, and lifestyle data on Voyica is provided for informational purposes only. It is not professional, legal, financial, immigration, or relocation advice. You are solely responsible for verifying any information before making travel, relocation, or financial decisions. Conditions change; data may be outdated or inaccurate.
9. Limitation of Liability
To the fullest extent permitted by law, Voyica’s total liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of $50 USD or the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
Some jurisdictions do not allow limits on certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify and hold harmless Vincent Catalano (operator of Voyica) from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any third-party rights.
11. Termination
You may stop using the Service at any time and delete your account from settings. We may suspend or terminate your access at any time, with or without cause, including for violation of these Terms. Sections that by their nature should survive termination (including Sections 6, 8, 9, 10, 12, and 13) will survive.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Travis County, Texas. You and Voyica each consent to personal jurisdiction and venue there.
Class action waiver. You agree to bring any claim against Voyica only in an individual capacity and not as a plaintiff or class member in any class or representative action.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced by updating the “Last updated” date and, where required, by email or in-app notice at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
14. Miscellaneous
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Voyica regarding the Service. If any provision is found unenforceable, the remainder will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent.
